ECHR did not accept claims of Tskhinval residents against Georgia

The European Court of Human Rights announced on Thursday that did not see any grounds for accepting several lawsuits in which the residents of Tskhinval accused the Georgian armed forces of life-threatening actions.

As noted in the court’s press release, the ECHR will not consider two of the three lawsuits filed by residents of the Republic of South Ossetia against Georgia on the events of August 2008.

The applicants, in particular, complained of a violation of the right to life, the right to liberty and security provided for by the Convention for the Protection of Human Rights.

The court found the evidence presented insufficient.

On the third lawsuit, the decision has not yet been taken. It was filed by Russian citizens living in August 2008 in Tskhinval. The document, in particular, states that the apartment suffered significant damage. The ECHR notified the Georgian authorities of this claim.

The lawsuits were filed by Isolda Kudukhov with her daughter Nino and the spouses Klara Nanieva and Umar Bagaev. The third lawsuit was filed by Khadizat Dzhioeva along with two daughters Irina and Alina Kachmazov. In August 2008, they, being citizens of Russia, were living in Tskhinval. Dzhioeva said that she had to escape from the shots of heavy artillery in the basement of her house. On 10 August, she left Tskhinval to meet her daughters, who had previously moved to the village. In September 2008, they returned to their apartment in Tskhinval and found that it had suffered serious damage. The ECHR decided that it would notify the government of Georgia about the complaints of Dzhioeva, but could not accept their daughters' claims because there was no serious risk for their lives because of the move to the village.

On the night of August 8, 2008, Georgian troops attacked South Ossetia and destroyed the city of Tskhinval. Georgia attempted the physical destruction of the Ossetian people.
