The State Duma of Russia ratified the agreement with South Ossetia on the recognition of documents of military invalids

On Wednesday the State Duma ratified an agreement between the Russian Federation and South Ossetia on the mutual recognition of documents confirming the disability of persons dismissed from the ministries of defense and internal affairs of the two countries. The document was signed on March 17, 2020.

The document provides for the regulation of the mutual recognition of documents confirming the fact of establishing the disability of dismissed persons, so that, at their choice, they can receive pensions either under Russian law or under the laws of South Ossetia. In this case, the principle of the identity of the wording of the causes of disability provided for by the legislation of both states will be applied.

The agreement applies to persons who have become disabled due to injury, contusion or illness received in connection with military service in the territory of the Republic of South Ossetia.

For the Russian part, the implementation of the Agreement will be controlled by Ministry of Labor, Ministry of Defense and Ministry of Internal Affairs of the Russian Federation, for the South Ossetian part - by Ministry of Health and Social Development, Ministry of Defense and Ministry of Internal Affairs of South Ossetia. The authorized bodies of the parties will inform each other about the legislation in force in their states that regulates the issues of establishing disability, about its changes.

The Agreement is concluded for 10 years and is automatically renewed for subsequent five-year periods.

As noted by Kazbek Taisaev, Deputy Chairman of the Committee for CIS Affairs, Eurasian Integration and Relations with Compatriots, the Agreement is aimed at developing cooperation between the Russian Federation and South Ossetia in the field of social protection of citizens of the two states who were dismissed from the Ministries of Defense and Ministries of Internal Affairs and became disabled due to injury, concussion , injury or illness received while serving on the territory of the Republic of South Ossetia.

“As a result, the aforementioned persons, at their choice, acquire the right to pension provision under the legislation of either the Russian Federation or South Ossetia. The Agreement meets the interests of the Russian Federation and is aimed at developing cooperation and integration between the Russian Federation and the Republic of South Ossetia,” Taisaev said.

As noted by First Deputy Labor and Social Protection Alexei Vovchenko, in the Russian Federation this is the first agreement on the mutual recognition of documents confirming the establishment of disability.
