The action group for holding a referendum on the unification of the Republic of South Ossetia with Russia sent a petition to the Central Election Commission of the Republic. This was reported to journalists on Wednesday by the press Secretary of the head of state, Dina Gassieva.
"The action group has included four presidents of the Republic: current president Anatoly Bibilov, ex-presidents Ludwig Chibirov, Eduard Kokoity, Leonid Tibilov. The initiative group consists of only 26 people - political and public figures," the press Secretary said.
“In accordance with paragraph 4 of Article 8 of the Constitutional Law “On the Referendum of the Republic of South Ossetia”, we are sending this application for registration of the action group to hold a referendum. The question proposed for submission to a referendum is: "Do you support the unification of the Republic of South Ossetia and Russia?", the text of the document reads.
According to her, the representatives of the initiative group are the Chairman of the Parliament Alan Tadtaev, the first Deputy Chairman of the Parliament Peter Gassiev, the assistant to the President Atsamaz Kasaev.
According to the constitutional law of the Republic "On a referendum", within 15 days from the date of receipt of the application, the CEC decides on the registration of the action group, issues a registration certificate to it. In case of refusal to register the initiative group, a reasoned decision of the CEC is issued. Denial of registration may be appealed to the Supreme Court in the manner prescribed by the legislation in force in the territory of the Republic of South Ossetia, the basis for refusal of registration can only be a violation by the initiative group of the provisions of the Constitution and the Law "On Referendum".
From the moment of receiving the registration certificate, the action group has the right to voluntarily and independently begin collecting signatures in support of holding a referendum within three months. After the collection of signatures is over, the CEC checks all documents within 15 days and sends its conclusion to the president.
The President, within 10 days from the date of receipt of the documents, sends them to the Supreme Court of the Republic with a corresponding request. The Supreme Court reviews compliance with the requirements of the Constitution and sends a decision to the President within 14 days, which is subject to immediate publication.
In case of a positive decision of the Supreme Court, the President is obliged to set the date of the referendum within 10 days. In case of a negative decision of the Supreme Court, all procedures are terminated.
