Case # 9292019: The Zar tragedy is an act of genocide, the perpetrators have been identified, no one will remain unpunished

In the recent history of South Ossetia, there are many sorrowful dates over which time has no power and which people will always remember. One of these is May 20. Exactly 29 years ago, on May 20, 1992, a convoy of cars and trucks was moving along the Zar road.

The exhausted civilians, women, children and old people left the besieged Tskhinval hoping to wait out the war in a safe place, but along the road, which was called the Road of Life, they were brutally shot by the Georgian fascists.

The General Prosecutor's Office of South Ossetia, during the investigation of the criminal case initiated after the aggression of Georgia, established numerous episodes of criminal actions of the Georgian armed formations on the territory of the Republic.

This crime of the Georgian nationalists still remains unpunished. On the fact of the shooting of civilians on the Zar road, the Prosecutor General's Office opened a criminal case No. 9292019. However, the search and detention of the guilty persons are difficult for known reasons. Participants of massive war crimes against the people of South Ossetia have been identified, criminal cases have been initiated against them, they are all put on the international wanted list.

Earlier it was reported that there were 47 people from the military and political leadership of Georgia on the list of wanted persons for these crimes.

The Prosecutor General's Office of South Ossetia provided the IA “Res " with a certificate on criminal case No. 9292019, initiated on May 20, 1992.

“The preliminary investigation established that on May 20, 1992, at about 11.30 a.m. on the eighteenth kilometer of the Tskhinval-Dzhava (Zar) highway, the unidentified persons of Georgian nationality opened fire from automatic weapons to hit four cars with passengers. As a result, about 50 citizens of the RSO came under fire, " the document says.

33 of them died on the spot from the received gunshot wounds, incompatible with life.

These are Alborova-Kochieva Irina Ilyinichna, Alborov Zaur Vasilievich, Bitiev Vladimir Ektievich, Byazrova Lyudmila Matveevna, Byazrov Albert Ivanovich, Gagloeva Irina Gavrilovna, Gagloev Vasily Georgievich, Gassieva Galina Zakharievna, Dzheranova Evgeniya Vasilyeva Andrey Melikoevich, Dzhioev Georgy Alekseevich, Dzhioev Stanislav Ivanovich, Kabisov Batradz Khazbievich, Kabisov Viktor Dmitrievich, Kairov Sergei Taimurazovich, Kachmazov Vitaly Sergeevich, Kokoeva Svetlana Zaurovna, Kokoev Vasily Aleksandrovich, Kokoev Yoska Alekseevich ,Kokoev Leonid Ilyich.Kochieva Valentina Romanovna. Kochieva Nazirzt Sabegovna, Kumaritov Soslan Davidovich, Laliev Ikko Padoevich, Ostaev Georgy Biboevich, Siukaeva Zemfira Viktorovna, Tedeev Mairbeg Rutenovich, Tseboev Georgy Kharitonovich and Tseboeva Natalia Georgievna, Chibirov Ruslan Anatolyevich, Chochiev Ermak Eliozovich.

The rest received various injuries. The Prosecutor General's Office has noted that it was not possible to identify the persons involved in the commission of this crime in hot pursuit.

"However, the witnesses to this incident Kumaritov Dmitry Grigorievich, Besaeva Arina Tengizovna, Plieva Marina Borisovna and Kotaev Shota Archilovich confirmed that on May 20, 1992, they were passing a section of the Tskhinval-Java (Zar) bypass road, as at this time the unknown persons began to fire at them, they could not see any of the shooters, but after the shelling, the surviving citizens of the Republic of South Ossetia managed to hear several phrases that were uttered by the shooters in Georgian, "the department notes.

This criminal case was suspended several times, since it was not possible to carry out investigative and operational-search measures aimed at identifying the persons involved in the commission of this crime within the time period established by the Criminal Procedure Code.

“On September 19, 1994, the present criminal case was reopened, the police officers managed to establish a witness to the above crime, V., who testified that, being in the village of Tamarasheni, he had learned from a citizen T. that the latter, together with his brother F., as well as citizens V. and R., with the support of the Akhaltsikhe battalion on the BMP, committed the indicated crime on May 20, 1992 in the village of Zar, "the document reads. In the interests of the investigation, the Prosecutor General's Office does not disclose the names of these persons.

As a result of the operational-search activities carried out by the State Security Committee of the Republic of South Ossetia, the information was obtained about the involvement of 20 citizens of Georgia in this crime, whose names are known.

On 28 November 2016, 10 of them were ordered to be charged in a criminal case.

On January 2, 2017, the accused in this criminal case were put on the international wanted list, in respect of them, the Tskhinvali District Court chose a preventive measure in the form of detention in absentia.

On July 17, 2018, criminal case No. 9292019 was withdrawn from the proceedings of the Military Prosecutor's Office of the Republic of South Ossetia and transferred for further investigation to the Investigation Department of the General Prosecutor's Office of the Republic of South Ossetia.

May 17, 2019, by written order of the Prosecutor General of the Republic of South Ossetia, State Counselor of Justice of the 3rd class U.F. Dzhagaev, the actions of the accused in this criminal case were re-qualified to Art. 357 of the Criminal Code of the Russian Federation - genocide.

The production of investigative actions and operational measures aimed at establishing the whereabouts and detention of those accused of committing the crime under investigation continues to this day.
